CDC’s quarantine authority invoked to ban evictions

The Trump administration has introduced a residential eviction moratorium using the Centers for Disease Control’s quarantine authority. But some in the real estate investment industry are concerned about the order’s wide reach.

Doug Bibby, president of the National Multifamily Housing Council, said in a statement: “We are disappointed that the Administration has chosen to enact a federal eviction moratorium without the existence of dedicated, long-term funding for rental and unemployment assistance. An eviction moratorium will ultimately harm the very people it aims to help by making it impossible for housing providers, particularly small owners, to meet their financial obligations and continue to provide shelter to their residents.”

The eviction moratorium applies to all residential properties nationwide, regardless of financing — unlike the temporary moratorium in the CARES Act, which applied only to renters in federally funded rental properties.
