New regulations effect and target foreign investors

On Jan. 13, 2020, the U.S. Department of the Treasury  published two final rules (Final Rules, found here and here) that implement most of the remaining provisions of the Foreign Investment Risk Review Modernization Act of 2018 (FIRRMA).

The proposed regulations are implemented pursuant to the FIRRMA, which was signed into law in August 2018. If enacted, these new proposed regulations could have major implications on foreign investment and real estate transactions in the United States.

CFIUS issued FAQs and a Fact Sheet describing the Final Rules, which will become effective on Feb. 13, 2020.
