Synopsis: The National Conference of State Legislatures is a Washington, D.C.,–based organization that in 2010 published a P3 Toolkit for Legislators to help state representatives better understand the P3 model and its opportunities. The NCLS has followed up its toolkit with a supplemental report whose objective is to connect the concepts from the P3 Toolkit with real-world examples and developments in P3 legislation. “As P3s have become a focus of the national conversation on infrastructure spending, it is important to consider what they can and cannot provide,” notes NCSL. “Even the most well-intended projects can go astray without proper oversight and consideration.” The report covers all types of P3 models, including design-build through design-own-operate-transfer and all the variations in between. It covers sectors from water to telecommunications to transportation and public/government properties, or social infrastructure. “States vary widely in their statutory approach to P3s, both in the scope of infrastructure included and the breadth of projects allowed,” notes NCSL. “While transportation remains the leading sector for P3s in the United States, in recent years states have begun to move towards expanding the authority to utilize P3s for other types of infrastructure, to varying degrees of success and frequency.”
